1. Acceptance of Terms
By accessing or using the website located at 4geeks.com (the “Website”), or by purchasing any product or service offered through it, including AI Flex, AI Fluency, and AI Engineering (together, the “Products”), you (“User,” “Client,” “you,” or “your”) agree to be bound by these Terms and Conditions (these “Terms”), together with our Privacy Policy, which together govern the relationship between Learnpack Inc (“Learnpack,” “the Company,” “we,” “us,” or “our”) and you. If you do not agree with any part of these Terms, please do not use the Website or purchase any Product.
“Party” or “Parties” refers to the Client and/or the Company, as the context requires. References to the foregoing terminology in the singular, plural, or with capitalization, and to “he,” “she,” or “they,” are interchangeable and refer to the same.
2. About 4Geeks Academy and Our Products
Learnpack Inc is a technology education company. Through the Website we offer, among other things, the following digital products:
AI Flex — a modular, self-paced library of AI-focused courses, offered as an annual subscription per seat.
AI Fluency — a live, part-time, instructor-led program designed to teach professionals how to apply AI tools and workflows in their day-to-day work.
AI Engineering — a live, cohort-based, instructor-led career-transition program. Enrollment in AI Engineering, and the corresponding payment, cancellation, and refund terms, are governed exclusively by the enrollment agreement signed by the student (the “Enrollment Agreement”), which varies according to the location in which the student enrolls. Section 5.3 below governs the relationship between these Terms and the Enrollment Agreement.
4Geeks Academy may also offer other products, services, cohorts, or bundles from time to time through the Website. Unless stated otherwise at the time of purchase, such offerings are governed by these Terms.
3. Use of the Website
3.1 No Warranty as to Website Content. Neither we nor any third party provides any warranty or guarantee as to the accuracy, timeliness, performance, completeness, or suitability of the information and materials found or offered on this Website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors, and we expressly exclude liability for such inaccuracies or errors to the fullest extent permitted by law.
3.2 Intellectual Property in Website Content. This Website contains material owned by or licensed to us, including but not limited to its design, layout, look, appearance, and graphics. Reproduction is prohibited except in accordance with the copyright notice forming part of these Terms. All trademarks reproduced on this Website that are not the property of, or licensed to, 4Geeks Academy are acknowledged.
3.3 Unauthorized Use. Unauthorized use of this Website may give rise to a claim for damages and/or constitute a criminal offense.
4. Purchases and Payment
When you purchase a Product through the Website, you authorize us to charge the payment method you provide the price displayed at the time of purchase, plus any applicable taxes. Prices are stated in U.S. dollars unless otherwise indicated and are subject to change; a price change will not affect a purchase already completed. You are responsible for providing accurate billing information and for all charges incurred under your account.
5. Refund Policy
This Section 5 sets out our refund policy for the Products purchased through the Website. It applies in place of, and takes precedence over, any general statement elsewhere in these Terms regarding refunds.
5.1 AI Flex. Purchases of AI Flex are final and non-refundable, except that a full refund will be issued if requested within twenty-four (24) hours of the original purchase. Refund requests must be submitted in writing to info@4geeksacademy.com within that 24-hour window. After the 24-hour period has elapsed, no refunds, credits, or exchanges will be issued for any reason, including partial use, non-use, or dissatisfaction with the Product.
5.2 AI Fluency. Purchases of AI Fluency are final and non-refundable, except that a full refund will be issued if requested within twenty-four (24) hours of the original purchase. Refund requests must be submitted in writing to info@4geeksacademy.com within that 24-hour window. After the 24-hour period has elapsed, no refunds, credits, or exchanges will be issued for any reason, including cohort start-date changes, partial attendance, or dissatisfaction with the Product.
5.3 AI Engineering. AI Engineering is not governed by Sections 5.1 or 5.2 above. Enrollment, tuition payment, cancellation, and refund terms for AI Engineering are governed exclusively by the Enrollment Agreement signed by the student at the time of enrollment, which reflects the specific terms applicable to the country, state, or region in which the student enrolls. In the event of any conflict between these Terms and a student’s signed Enrollment Agreement with respect to AI Engineering, the Enrollment Agreement will control. Students should refer to their Enrollment Agreement, or contact admissions at info@4geeksacademy.com, for the refund policy applicable to them.
5.4 General. All refund requests must be submitted in writing through the channel specified above, or as otherwise instructed at checkout. Refunds, where applicable, will be issued to the original payment method within a commercially reasonable time. 4Geeks Academy reserves the right to verify the timing and circumstances of any refund request.
6. Intellectual Property; License to Use the Service
Subject to the terms and conditions of these Terms, you are hereby granted a non-exclusive, limited, non-transferable, freely revocable license to use the Products and the Website for your personal, non-commercial use only and as permitted by their features. 4Geeks Academy reserves all rights not expressly granted herein in the Products, the Website, and their content. 4Geeks Academy may terminate this license at any time for any reason or no reason, subject to any rights you may separately hold under a signed Enrollment Agreement.
7. Privacy; Cookies; Log Files
7.1 Privacy Statement. We are committed to protecting your privacy. Only authorized employees, on a need-to-know basis, use information collected from individual customers. We regularly review our systems and data to ensure the best possible service. We will investigate, and may pursue civil or criminal proceedings against, any unauthorized action against our computer systems or data.
7.2 Log Files. We use IP addresses to analyze trends, administer the Website, track user movement, and gather broad demographic information in the aggregate. IP addresses are not linked to personally identifiable information. For systems administration, usage-pattern detection, and troubleshooting, our servers automatically log standard access information such as browser type, access times, URLs requested, and referral URLs. This information is not shared with third parties and is used only within 4Geeks Academy on a need-to-know basis. Any individually identifiable information related to this data will never be used in a manner different from that stated above without your explicit permission.
7.3 Cookies. Like most interactive websites, 4geeks.com uses cookies to retrieve user details for each visit and to enable certain functionality and ease of use. Some of our partners may also use cookies. See our Privacy Policy for further detail.
8. Links To and From This Website
You may not create a link to any page of this Website without our prior written consent. If you create a link to a page of this Website, you do so at your own risk, and the exclusions and limitations set out in these Terms will apply to your use of the Website by linking to it.
We do not monitor or review the content of third-party websites linked to from this Website. Opinions expressed or material appearing on such websites are not necessarily shared or endorsed by us, and we should not be regarded as their publisher. We are not responsible for the privacy practices or content of those sites. We encourage you to review the privacy statements of any third-party site before disclosing personal information to it.
9. Disclaimer; Exclusions and Limitations
The information on this Website is provided on an “as is” basis. To the fullest extent permitted by law, 4Geeks Academy: (a) excludes all representations and warranties relating to this Website and its contents, including in relation to any inaccuracies or omissions in this Website; and (b) excludes all liability for damages arising out of or in connection with your use of this Website, including, without limitation, direct loss, loss of business or profits, damage to your computer or software and the data thereon, or any other direct, indirect, consequential, or incidental damages.
This does not exclude liability for death or personal injury caused by our negligence. The foregoing exclusions and limitations apply only to the extent permitted by law and do not affect your statutory rights as a consumer.
10. Force Majeure
Neither party will be liable to the other for any failure to perform an obligation under these Terms or an Enrollment Agreement that is due to an event beyond its reasonable control, including but not limited to acts of God, terrorism, war, political insurgence, insurrection, riot, civil unrest, acts of civil or military authority, earthquake, flood, or any other natural or man-made event outside of that party’s control, and which could not reasonably have been foreseen. A party affected by such an event shall promptly inform the other party and use all reasonable efforts to comply with these Terms to the extent possible.
11. General Provisions
11.1 Dispute Resolution. Any dispute arising out of or in connection with these Terms shall be finally settled by binding arbitration administered in accordance with the Commercial Arbitration Rules of the American Arbitration Association, by one or more arbitrators appointed under those rules, seated in Miami-Dade County, Florida. No award or procedural order made in the arbitration shall be published. Nothing in this Section 11.1 limits either party’s right to seek injunctive relief in a court of competent jurisdiction.
11.2 Severability. If any provision of these Terms is deemed invalid or unenforceable for any reason, that provision will be severed, and the remaining provisions will continue in full force and effect.
11.3 No Waiver. 4Geeks Academy’s failure to enforce any provision of these Terms, or to exercise any right to terminate, will not be construed as a waiver of that provision and will not affect our right to enforce it thereafter.
11.4 Amendment. These Terms may not be amended, modified, varied, or supplemented except in writing signed by a duly authorized representative of 4Geeks Academy, except as set out in Section 13 (Changes to These Terms).
12. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Florida, United States of America, without regard to its conflict-of-laws principles. Because of the international nature of electronic communications, users accessing the Website from other countries remain responsible for compliance with any mandatory local law applicable to them.
13. Changes to These Terms
4Geeks Academy reserves the right to change these Terms at any time, including changes to our Privacy Policy, the configuration and content of the Website, or the conditions required for access to or use of it, and to interrupt, suspend, or terminate access to the Website or its content, as it sees fit. Your continued use of the Website following any such change constitutes your acceptance of the revised Terms. No User is entitled to demand compensation as a result of such changes.
These Terms form part of the agreement between the Client and 4Geeks Academy. Accessing this Website and/or completing a booking, purchase, or other agreement indicates your understanding of, agreement to, and full acceptance of these Terms. Your statutory consumer rights are unaffected.
